US Court Mandates Release of Abrego Garcia from ICE Custody

Legal proceedings

A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation originates in a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an error. Following his repatriation to the United States to face alien smuggling allegations, he was held in federal detention.

In her decision, the judge noted that the authorities does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Case

The legal challenge center on disputed assertions. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate trial in Tennessee.

Conditions of Release

The court, who was overseeing his petition to deportation in a Maryland district court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.

This decision marks a notable development in a complex legal case featuring allegations of mistaken imprisonment and contested criminal associations.
